You are required to write a report containing the following parts:

Using examples, discuss the four elements of a contract under English law and their importance in concluding a contract for the international trade of goods.

You have secured a summer internship position with Smith’s International, a leisurewear company based in Plymouth, with 60% of its turnover depending on the European free market area. In the context of the UK leaving the European Union (EU), the Board has launched a review of its sales and marketing strategy with the view to securing new export markets in anticipation of when the UK leaves the European free market area.  As part of a team of three researchers, your task consists of exploring market opportunities in the North America Free Trade Area (NAFTA) and advising the International Sales Department accordingly. Specifically, the Director of International Sales Department to whom you report would like to gain a better understanding of NAFTA, a free trade area of comparable size to EU and Incoterms 2020 that would be suitable for direct exporting into NAFTA.

 

Instructions: In a formal report,advise the Director of International Sales Department on NAFTA and INCOTERMS 2020 including your recommendations for TWO most suitable Incoterms for the direct export of leisurewear to a new market. Your report must cover three main points:

  • NAFTA as a free trade area and what it means for Smith International as a direct exporter;
  • INCOTERMS 2020 with specifications in each category or class of Incoterms  in respect of risk and responsibilities of  parties;
  • TWO Incoterms you would recommend as most appropriate to Smith International including the key points to be included in the costing, should the company decide to export directly to a new market.
