  1. Tasks

 

Answer the question below in an appropriate format of legal essay with reference to relevant legal authorities.

 

On 25 February 2020, Vivian surf the internet and visited an online purchase platform named BeautyLike.com which provide sales of various merchandises and services. Vivian put in her shopping cart several items include two dresses, one blouse and three small accessories. Before proceed for payment, Vivian asked one of the merchants, DressDrop, by using the message box on BeutyLike, whether the size of one of the two dresses and colour are available. Having learned from the merchant that there is no appropriate size and colour available, Vivian was thinking about not buying the two dresses. She then sends a message to the merchant and informed them that she rejects both of the dresses. However, Vivian was panicked seeing the time lapse for performing the transaction online. She did not unclick the two dresses from the shopping cart and brought all the items online. She had paid RM599 for everything in her shopping cart. She then quickly sends another message and e-mail to inform the DressDrop that she brought the dresses by mistake. However, she never hears anything from the DressDrop.

 

After 1 week, Vivian received the all items and she wants to rejects the dresses by sending back to DressDrop and get her money back by refund. Both the dresses cost RM 299. She is unsure whether she can do that and come to ask your advice.

 

Advise Vivian with the legal issues involved with support of relevant statutory and case laws.

 

3.1       Objectives

 

The students are required to demonstrate their understanding on the law of contract relating to offer and acceptance. Students are required to attempt this case study by applying the following guidelines:

  identify the relevant legal issues

  apply the legal principles from cases or statute

  develop legal arguments from these principles

  arrive at a considered conclusion.

 

Generally the students are awarded marks on their ability to figure out the appropriate laws particularly within the scope of offer and acceptance of the contract in  governing the situation and demonstrate the relevancy of the selected laws to the given situation. Students need to provide the relevant statutory provisions and case laws to support their arguments.. This exercise would provide the students with a rich understanding on the formation of agreement and its legal consequences.

The students are expected to discuss and apply the following legal principles:

  • Definition and rules of offer and how it is different from invitation to treat (ITT);
  • The legal position of ITT in the case of advertisement;
  • The ways an offer and acceptance may be revoked;
  • The definition of acceptance and the rules in regulating an enforceable acceptance.
  • Other legal issues involved in the question.

81 – 100 Covers the issue well, is well written, and has interesting arguments
71 – 80 Covers the issue well and well written
61 – 70 Covers some issues poorly and has some writing problems
51 – 60 Covers the issues poorly and has some writing problems
0 – 50 Does not cover the issues and has major writing problems

 

 

General criteria for grading THE SUBJECT KNOWLEDGE:

 

  • Accuracy of the legal points and explanation;
  • Relevancy of examples i.e. decided cases and/or statutory provisions cites in the answer;
  • Ability to employ own words in explaining legal points and citing decided cases and/or statutory provisions;
  • Ability to organize answer as a readable legal essay;
  • Ability to argue and defend the points legally;
  • Proof of research i.e. by providing information which is outside the lecture notes;
  • Evidence of extra research and relevant further readings by students.

Grading Bands are as follows:

 

A+       –           90 – 100 marks

A         –           80 – 89 marks

A-        –           75 – 79 marks

B+       –           70 – 74 marks

B         –           65 – 69 marks

B-        –           60 – 64 marks

C+       –           55 – 59 marks

C         –           50 – 54 marks

C-        –           45 – 49 marks

D         –           40 – 44 marks

F          –           0 – 39 marks

 

Note:   Marking will be done based on impression, judgment and content.

 

 

  1. Coursework submission

 

 

Students are required to submit the coursework via soft copy/electronic copy only via Blackboard.
